These Terms of Use ("Terms") govern your access to and use of our website www.niigo.app (the "Website") and the Niigo mobile application (the "App"). Collectively, the Website and App are referred to as the "Platform." Please read these Terms carefully before using the Platform. By accessing, using, or downloading from the Platform, you agree to comply with these Terms, along with all applicable Niigo policies (such as our Privacy Policy, Refund & Cancellation Policy, etc.), which together form a binding legal agreement between you and Niigo.
 
If you do not agree to these Terms, please do not access or use the Platform, and uninstall the App if already installed.
 
These Terms apply to all users of the Platform, including individuals of all ages, as well as businesses and organizations.

Use of the Platform and Services

All commercial and contractual terms are strictly between Buyers and Merchants. These include, but are not limited to: pricing, taxes, shipping, delivery, payment methods, warranties, and after-sales services. Niigo does not control or intervene in these agreements.
Niigo acts as a digital intermediary that facilitates communication and transactions between users and Merchants. While we may assist with order placement, payment processing, or customer support, we are not a party to the commercial contract.
 
We are not responsible for:
  1. Non-performance or breach of contract by a Merchant.
  2. Delivery delays, product unavailability, or order issues.
  3. Product quality, safety, or compliance.
  4. Mismatches between menu images or prices and actual offerings.

User Accounts and Information

To access certain features, users must create an account. During registration, you may be required to provide information such as your name, email, and contact number. You agree to provide accurate and complete information.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Orders, Deliveries, and Fulfillment

Estimated delivery times are provided for reference only and may vary. Niigo is not liable for delays caused by third-party logistics or Merchants.
Orders will be delivered to the address specified at checkout. If a delivery fails due to incorrect address, lack of instructions, or unavailability of the recipient, the order will be considered fulfilled and no refund will be issued.

Payments

Niigo facilitates payments through trusted third-party gateways. When placing an order, you agree to use authorized and valid payment methods. We do not store card details or payment information on our servers.
Users are responsible for maintaining the security of their payment credentials.
Niigo may assist with refunds, cancellations, or payment disputes as per our policies, but we are not liable for any unauthorized transactions.

Prohibited Activities

You agree not to use the Platform for:
  1. Illegal or unauthorized purposes.
  2. Sharing harmful, offensive, or misleading content.
  3. Infringing on intellectual property rights.
  4. Spamming, phishing, or transmitting malware.
  5. Impersonation or false identity.
  6. Disrupting Platform operations.
We reserve the right to suspend or terminate accounts that violate these Terms.

Cancellations and Refunds

Niigo reserves the right to cancel any order at any time due to issues such as unavailability, delivery constraints, or operational problems. For user-initiated cancellations and refund eligibility, refer to our Cancellation & Refund Policy.

Changes to Terms

We may update these Terms from time to time. Continued use of the Platform after such updates implies your acceptance of the revised Terms. We encourage you to check this page periodically.
